I think he's a little outside the protection of free speech, because it's a rule related to his job that he's dealing with. He couldn't face criminal charges for speaking freely, but he might reasonably be discharged. I approve of him pushing it as far as he can get away with; I just hope he doesn't doesn't go too far and get the boot. It looks to me like he's thinking the same thing.
