    You will be pleased to know that patents are now awarded first to file in the USA.

    Don't worry -- a clause in the Constitution prohibits first to file grant of patent.

    I'm confused. Are you saying that the USA is doing something unconstitutional? (which would not be a surprise). It sounds like you mean: yay, we can get the patent if we're first to file, but boo, it's unconstitutional for us to get the patent by being first to file.

    Oh okay. What would happen if patents were awarded first to file? Is that bad?

    It sounds like a situation where two people thought of a similar idea, and whoever files first gets the patent. That's what I'm imagining.

    And, why wouldn't the first person to file get the patent? Why would that be undesirable?

    Don't worry, it was not the real inventors that profited from the patent reglementations, but the companies. ILEs were never characterized by a strong spirit of possessiveness, BTW.

    It promotes idea theft and ownership of ideas by people other than the inventors. Why is that NOT undesirable?

    And another effect: under first-to-invent, a person could claim "prior art" and thus prevent patents from being filed. Under first-to-file, prior art doesn't matter: the first to ask for rights gets them. Basically it's clearance for the right wing to take marketing ability for every idea out there.

    How come the real inventors didn't profit as much as the companies did?
